    Section 200:23 Pension plan — Defined benefit plan — Noncontributory

    PENSION PLAN

    This plan is adopted by ______THE BEAU MONDE________ [name of company] ____BEAU IDEAL____ [name of owner] for the purpose of providing for the payment of definite amounts to its eligible employees when they are disabled by accident or sickness or when they are retired from service with the company, or, in the event of death, to their beneficiaries. Benefits are related to compensation and years of service with the company and are in addition to Social Security benefits.

    ARTICLE ONE DEFINITIONS

    1. Plan "Plan" shall mean the _______PENSION PLAN_______ [name of plan], established by ______THE BEAU MONDE_______ [name of company] ____BEAU IDEAL_____ [name of owner] for the benefit for eligible employees, which plan is intended to quality as a qualified employees' pension plan under the appropriate provisions of the Internal Revenue Code and Employee Retirement income Security Act of 1974.     2. Employer. "Employer" shall mean the person, firm, or corporation named above who has adopted the plan.
    3. Employee. "Employee" means a person currently employed by the employer any portion of those whose income is subject to withholding of income tax and for whom Social Security contributions are made by the employer, as well as any other person qualifying as a common-law employee of the employer.
    Eligible Employee. "Eligible Employee" shall mean every employee except the following.
    (A) An employee who has not attained the age of ___18__ years and,
    (B) An employee who is nonresident alien and who receives no earned income within e meaning of (section) 861(a)(3) of internal revenue Code.
    5. Member. "Member. Shall mean any eligible employee who has become a member of this plan.
    6. Retired Member. "Retired Member" shall mean a member who has terminated active with the employer and is receiving benefits under under the plan.
    7. Beneficiary. "Beneficiary" shall mean a person or persons entitled under the provisions of this plan to receive benefits after the death of a member.
    8. Effective Date. "Effective Date"'shall mean __MAY 29, 2020_ [date ].

It shall not include any bonuses or special pay for overtime work.     11. Committee. "Committee" shall mean the administrative committee administrative committee appointed and acting in accordance with the provisions of Article Eight of this plan.
